  • Corporate Assets Inc., in obtaining a favourable judgment of nearly C$17M in principal and interest in connection with a call for tenders for the sale of assets of the Aleris plant in Trois-Rivières. This decision on the merits is in addition to a previous decision by which, for the very first time in Quebec, the Court rejected litigation privilege on the basis of the defendants' improper conduct.
  • Loupy’s – successfully represented Gilles Lupien's holding company, which obtained a judgment for more than C$4.1 Million in principal and interest in an action for cancellation of a lease and damages against a major real estate developer.
  • A public company, as lead litigation partner, in its challenge before the courts of Goldcorp Inc.’s hostile take-over bid and in the ensuing C$3.9B sale to white knights Yamana Gold Inc. and Agnico-Eagle Mines Limited.
  • Lowe’s, as lead litigation partner, in its high-profile C$3.2B acquisition of RONA Inc. by way of a Court-approved plan of arrangement.
  • A development capital company in major commercial litigation matters including a substantial oppression remedy case which permitted the closing of a transaction worth more than C$90M.
  • The co-founder and shareholder of one of Canada’s largest private high-tech companies in an oppression remedy case.
  • Airboss of America Corp. et al v. Famcorp Inc. et al. – Successful representation of a public company and its subsidiary before the Superior Court and the Court of Appeal in a major transactional litigation matter relating mainly to claims for adjustment of the purchase price of shares acquired for C$34M.
  • Several clients in many post-transaction disputes relating to purchase price adjustments, misrepresentations, breaches of warranty, and indemnification.
  • Several financial institutions, in their defense against various class actions and other disputes including injunctions and remedy in damages related to account closures or demarketing.
  • Car manufacturers and importers in several major class actions on various product liability and consumer protection issues and various matters related to the Consumer Protection Act.
  • Billette v. Mazda Canada Inc. – Succeeded in obtaining for his client the discontinuance of a class action of several hundreds of millions of Canadian dollars on complex issues related to the Consumer Protection Act.
  • Pilon v. Mazda Canada Inc. – Succeeded in obtaining for his client the discontinuance of a class action of several hundreds of millions of Canadian dollars on complex issues related to the Consumer Protection Act, including matters related to the disclosure and calculation of credit rates in contracts.
  • Contat v. Mazda Canada Inc. et al. – Succeeded in obtaining for his client the discontinuance of a class suit of several hundreds of millions of Canadian dollars on complex issues related to the Consumer Protection Act.
  • Marandola v. Mazda Canada Inc. et al. – Succeeded in obtaining for his client the discontinuance of a class action of several hundreds of millions of Canadian dollars.
  • Durand v. Subway – Successfully acted for Subway Franchise Systems of Canada ULC and Doctor's Associates LLC in their challenge of an application for authorization alleging, among other things, violation of the Consumer Protection Act and the Civil Code of Québec.
  • Benabu v. SiriusXM Canada Inc. et al. - Successfully represented SiriusXM in its challenge of a motion for authorization to institute a class action.
  • Gagné v. Rail World, Inc. & al. – Represented a major public corporation in its defense against a class action widely covered by the media, instituted following the train derailment in Lac Mégantic.
  • A number of franchisors in various fields, acting as a strategic as well as legal advisor on a regular basis. Frédéric has been involved in more than a hundred disputes relating to franchise law and real estate law.
